takedown notices

A formal channel for rights-holders and affected parties to submit notices. We consider all valid and complete notices in good faith.

If you are a rights-holder or its authorised representative and believe that a specific listing infringes your exclusive rights — send a notice to abuse@divergent.market. General enquiries unrelated to IP infringement go to support@divergent.market.

Mandatory notice elements

  1. 1A physical or electronic signature of an authorised representative.
  2. 2Precise identification of the protected work: title, registration number (if any), a link to a public source.
  3. 3The URL or identifier of the specific listing on the Platform (short listing ID or full URL).
  4. 4Claimant contact details: name, postal address, email, phone.
  5. 5A good-faith statement that the use of the material is not authorised by the rights-holder, its agent or by law.
  6. 6A statement, under penalty of perjury, that the notice is accurate and that the claimant is authorised to act on behalf of the rights-holder.

How we handle the notice

  • We acknowledge receipt within 3 business days.
  • Where one or more mandatory elements are missing we indicate that and wait for completion. Incomplete notices are not processed.
  • Complete and substantiated notices are reviewed within 14 business days.
  • If a decision is in the claimant's favour the disputed material is removed or access to it is restricted.
  • The user whose material was restricted may submit a counter-notice.
  • False or bad-faith notices may trigger legal consequences for the claimant under the law of the Operator's jurisdiction.

Counter-notice

A user whose material was restricted pursuant to a notice may, within 14 days, submit a counter-notice to the same address, identifying the material, making a good-faith statement that the removal was mistaken and consenting to the jurisdiction of the courts in the Operator's place of registration.

The Operator reserves the right to disregard mass, automated, duplicated or manifestly bad-faith notices and any notice submitted outside of this procedure.
